Content Release

As a Nesquik Breakers team member, I will be submitting materials to NESTLE® NESQUIK® in connection with activities, such as photographs, my own artwork and other materials that I create (“My Content”), which Nestle may want to use. I hereby irrevocably grant to Nestle a free, unlimited right and license to distribute, publish, display, modify, and create derivative works (collectively, “Use”) My Content. I understand that My Content may be distributed by any means, though Nestle does not have any obligation to make any Use of my Content. I acknowledge that Nestle’s use of my Content does not give me any rights to use Nestle’s intellectual property. My Content will be created by me. To the best of my knowledge, neither My Content nor any Use of My Content by Nestle will violate or infringe upon the rights of any third parties. I agree that any intellectual property rights that may exist in My Content shall be owned by Nestle. I hereby grant Nestle the royalty-free right to use my first name, the initial of my last name, and the city where I live in connection with My Content. I hereby release and discharge Nestle and its affiliates from and against any claims that I may have arising out of Nestle’s Use of My Content. Any disputes arising out of or related to My Content or these terms and conditions shall be governed by the laws of the State of New York.
